1. About these Terms
These Terms & Conditions apply to all purchases made from Chocolate Wood — online at chocolatewood.com.au, by telephone, by email, or in our showroom. By placing an order with Chocolate Wood, you agree to these Terms & Conditions.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law. Where any part of these Terms is inconsistent with the Australian Consumer Law, the Australian Consumer Law prevails.
2. Change of Mind — No Refunds
Chocolate Wood does not provide refunds for change of mind.
Customers who notify Chocolate Wood within 7 days of receiving their goods may request an exchange or store credit, subject to approval and to the conditions of our Returns & Warranty Policy.
Store credit is valid for 12 months from the date of issue. No restocking fee applies.
For an approved change-of-mind return or exchange:
- Original delivery and freight charges are non-refundable and are not included in the value of any store credit or exchange.
- The customer is responsible for all return freight costs. Chocolate Wood does not provide a prepaid return shipping label. The customer arranges and pays for the return freight.
- Where an exchange is requested, the customer is also responsible for all freight and delivery costs of sending the replacement product to them.
For clarity: original freight + return freight + replacement freight (where applicable) are all borne by the customer. Chocolate Wood does not absorb any of these costs.
Returned goods must meet the return-condition requirements set out in our Returns & Warranty Policy.
Return approval and return location. Customers must contact Chocolate Wood and obtain approval before returning anything. Once approved, we will provide the nominated return location, which may be a Chocolate Wood Sydney location or the Sydney warehouse or premises of an affiliated trading partner nominated by Chocolate Wood. Please do not return goods to any location until we have provided return instructions.
This change-of-mind policy does not exclude, restrict or modify any rights or remedies available under the Australian Consumer Law. Where goods are faulty, damaged, incorrectly supplied, not as described, or otherwise fail to meet a consumer guarantee, section 10 applies and the conditions above do not.
3. Product Information
We take reasonable care to ensure that product descriptions, specifications, dimensions, materials and pricing shown on our website are accurate.
Minor errors or omissions may occasionally occur. Where we identify a material error affecting an order, we will contact you as soon as reasonably possible to discuss your options, which may include proceeding, amending or cancelling the order with a full refund of any amount paid.
Dimensions are approximate and may vary slightly between individual pieces, particularly on handcrafted and solid timber furniture.
4. Natural Materials, Images & Colour
Our furniture is made from natural and manufactured materials including solid timber, veneer, rattan, cane, leather, stone and metal.
Natural materials vary. Differences in grain, colour, tone, texture, knots, filled knots, growth markings, hide markings and figuring are inherent characteristics of the material and are not faults or defects.
Timber is a living material. Some seasonal movement, expansion and contraction, and gradual colour change with exposure to light are normal and are not defects. Where a product is described as recycled, reclaimed or rustic, visible nail holes, saw marks, patina and previous-use markings are intended features.
Colours and finishes may appear different from the physical product depending on photography, lighting, your screen and its settings, and the natural characteristics of the material. Reasonable variation between a website image and the physical product, where it does not amount to a fault, defect or failure to meet a consumer guarantee, is not grounds for a remedy — though it may be grounds for a change-of-mind request under section 2.
If colour, finish or material is critical to your purchase, please contact us before ordering. We are happy to provide additional photographs, further detail, timber samples, or arrange for you to view a piece in our showroom.
5. Orders, Pricing & Payment
All prices are in Australian dollars and include GST unless otherwise stated. Prices exclude delivery unless expressly stated.
Placing an order is an offer to purchase. An order is not accepted until we confirm acceptance. We may decline or cancel an order where an item is unavailable, where there is a material pricing or listing error, or where we cannot reasonably supply the goods. In those circumstances we will contact you and refund in full any amount paid.
Prices, promotions and discounts may change without notice. The price that applies to your order is the price confirmed in your order confirmation.
Payment is required in full before goods are dispatched or released for collection, unless we have expressly agreed otherwise in writing. Paid items can be held for collection or delivery for up to 6 months by arrangement.
6. Custom-Made, Made-to-Order & Special Orders
Custom-made, made-to-order, personalised and specially manufactured furniture is built or procured specifically for you. Every detail is confirmed with you in writing before production begins — specifications, materials, finish, dimensions and price. Please check that confirmation carefully; once production has commenced, changes may not be possible and may incur additional cost.
These products are final sale for change-of-mind purposes. They cannot be returned or exchanged for change of mind and are not eligible for change-of-mind store credit.
Estimated production time is 3–4 weeks plus delivery. This is an estimate only and is not a guaranteed completion or delivery date.
This does not affect any rights or remedies available under the Australian Consumer Law where goods are faulty, defective, not as described, or otherwise fail to meet a consumer guarantee.
7. Floor Stock, Clearance & Ex-Display Items
Floor stock, clearance, ex-display and second-quality items are sold in their existing condition. Any known marks, wear or imperfections are disclosed at the time of sale and are reflected in the price.
These items are not eligible for change-of-mind return.
Your rights under the Australian Consumer Law still apply, but they do not extend to a fault or condition that was disclosed to you before purchase.
8. Delivery & Estimated Timeframes
All delivery dates and estimated times of arrival are estimates only unless we have expressly agreed otherwise in writing. Timeframes vary according to stock availability, the supplier, the destination and the freight arrangements applicable to your order.
Furniture supply and delivery can also be affected by manufacturing schedules, freight carriers, weather, transport conditions and other circumstances outside our reasonable control. We will always try to meet the timeframe given, but we cannot guarantee against unforeseen delay, and we will make reasonable efforts to keep you informed of any material delay.
Delivery charges are calculated on the delivery address and the size and weight of the goods. A freight calculator is available on our product pages so you can obtain a quote before purchasing.
We are not directly liable for loss, theft or damage to goods in transit, but we will assist you in pursuing the matter with the carrier. This does not limit your rights under the Australian Consumer Law.

9. Delivery Access & Your Responsibilities
Our delivery service includes taking the furniture to your room of choice and positioning it in your desired location within that room, subject to safe and reasonable access. Anything further — including installation or assembly where not specifically included, and packaging or rubbish removal — may incur an additional charge.
Before your delivery, please make sure the goods will fit. You are responsible for confirming that the item can be moved through all access points to its intended location — doorways, hallways, stairwells, lifts, corners, and any height or width restrictions.
Please also ensure that:
- someone aged 18 or over is present to receive and sign for the delivery;
- clear and safe access is available to the delivery point;
- the delivery area is clear of obstructions; and
- any building, strata, lift booking or parking requirements have been arranged in advance.
Stairs, difficult access and other special delivery requirements may incur an additional charge. Where a delivery cannot be completed because access is inadequate, nobody is available to receive the goods, or incorrect delivery details were provided, a re-delivery fee may apply. Where the goods cannot be delivered at all for those reasons and the order is cancelled, the return is treated as a change-of-mind return under section 2.
Our delivery service does not include removal of doors, windows, railings or fittings, hoisting, craning, or delivery by any means other than standard access, unless separately arranged and quoted.
Please inspect your goods on delivery, or as soon as reasonably possible afterwards, note any issue with the delivery team where possible, and retain the original packaging until you are satisfied with them.
10. Faulty, Damaged or Incorrect Goods
If goods are faulty, damaged, incorrectly supplied, not as described, or otherwise fail to meet a consumer guarantee, please contact us as soon as reasonably possible with your order details and a description of the issue.
We may reasonably request photographs, video, further information, or an opportunity to inspect the goods so the problem can be properly assessed.
The remedy available depends on the circumstances and on the requirements of the Australian Consumer Law. For a major failure you may choose a refund, a replacement, or compensation for any reasonably foreseeable loss. Where a failure is not major, we may choose to repair, replace or refund.
Where goods are returned because of a fault or a failure to meet a consumer guarantee, you do not bear the cost of returning them. The 7-day change-of-mind period and the freight conditions in section 2 do not apply to these claims, and original packaging is not a condition of exercising these rights.
Damage caused by misuse, neglect, accident, unsuitable environmental conditions, incorrect assembly, unauthorised modification, unsuitable cleaning products, exposure to excessive heat, moisture or direct sunlight, commercial use of goods sold for domestic use, or ordinary wear and tear is not a manufacturing fault.
11. Manufacturer's Warranty
Chocolate Wood furniture carries a 12-month manufacturer's warranty against manufacturing faults from the date of delivery, unless a different period is expressly stated for a particular product.
The warranty covers manufacturing and structural defects arising in normal domestic use. It does not cover the matters listed at the end of section 10, nor the natural variation described in section 4. It applies to the original purchaser and is not transferable.
This warranty is provided in addition to, and does not replace or limit, any rights or remedies available under the Australian Consumer Law. The 12-month period is not the maximum period during which your statutory consumer guarantee rights may apply — those rights may continue for longer, depending on the price and nature of the goods and what a reasonable consumer would expect.
Where an issue arises outside the warranty period, we will still do our best to assist. Full details are in our Returns & Warranty Policy.
12. Care & Product Safety
Furniture should be cared for in accordance with any care instructions supplied with the product or shown on the product page. Unsuitable cleaning products or unsuitable conditions can damage finishes and materials, and may affect a warranty claim.
Anchoring. Tall or top-heavy furniture — including bookcases, tallboys, dressers, display cabinets and entertainment units — should be anchored to a wall where there is any risk of tipping, particularly in homes with young children. 13. Cancellations
You may request to cancel an order before it is dispatched or before production commences. Cancellation is not automatic and must be confirmed by us.
Where an order is cancelled before dispatch and before production has commenced, we will refund the amount paid.
Where goods have already been dispatched, the request is treated as a change-of-mind return under section 2.
Custom-made, made-to-order, personalised and specially manufactured products cannot be cancelled once production has commenced (see section 6).
14. Australian Consumer Law
Our change-of-mind policy and our 12-month manufacturer's warranty are additional to your statutory rights.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
15. Liability
To the extent permitted by law, and subject to section 14, Chocolate Wood is not liable for indirect or consequential loss arising from the supply of goods, or for loss or damage caused by misuse of a product, incorrect assembly, or use of a product other than for its intended purpose.
Nothing in this section limits our liability under the Australian Consumer Law, for death or personal injury caused by our negligence, or for any liability that cannot lawfully be limited.
16. Privacy
Personal information collected in connection with your order is handled in accordance with our Privacy Policy, available on our website.
17. Changes to these Terms
We may update these Terms & Conditions from time to time. The version that applies to your order is the version published on our website at the time your order is placed.
18. Governing Law
These Terms & Conditions are governed by the laws of New South Wales, Australia. You and Chocolate Wood submit to the non-exclusive jurisdiction of the courts of New South Wales.
